In accordance with s. 943.0542 and s. 435.04 the Acreage Athletic League is conducting Level 2 background screenings for all volunteers, to include coaches, assistant coaches, team managers, team moms and BOD members. The statutes mentioned above are explicit regarding the infractions which will result in disqualification of affiliation. Florida s. 435.07 provides for possible exemptions from disqualification. This statue contains a list of offenses which are prohibited from exemption, absolutely, however allows for the remainder of offenses listed under s. 435.04 to be considered for exemption under the following circumstances:
1. Felonies for which at least 2 years have elapsed since the applicant for the exemption has completed or been lawfully released from confinement, supervision, or nonmonetary condition imposed by the court for the disqualifying felony;
2. Misdemeanors prohibited under any of the statutes cited in this chapter or under similar statutes of other jurisdictions for which the applicant for the exemption has completed or been lawfully released from confinement, supervision, or nonmonetary condition imposed by the court;
3. Offenses that were felonies when committed but that are now misdemeanors and for which the applicant for the exemption has completed or been lawfully released from confinement, supervision, or nonmonetary condition imposed by the court; or
4. Findings of delinquency. For offenses that would be felonies if committed by an adult and the record has not been sealed or expunged, the exemption may not be granted until at least 3 years have elapsed since the applicant for the exemption has completed or been lawfully released from confinement, supervision, or nonmonetary condition imposed by the court for the disqualifying offense.
The Acreage Athletic League is aware of and acknowledges this statue however, this organization will exercise its discretion to extend the elapsed time from at least 2 years to 10 years have elapsed since the applicant for the exemption has completed or been lawfully released from confinement, supervision, or nonmonetary condition imposed by the court for the disqualifying felony.
The Acreage Athletic League believes that the safety and security of our athletes is of paramount importance, and this addition to the current statues condition is in keeping with our previous background screening policy which was derived for that purpose. The AAL encourages all potential volunteers to review the statutes in order to be fully informed about the process.
